Terms of Service

These terms are an agreement between you and Talent Tick(“we”, “our”) covering your use of the Talent Tick platform. By creating an account or using the service, you agree to them. If you don’t agree, don’t use the service.

1. The service

Talent Tick is a multi-tenant SaaS platform for recruiting teams. It provides job posting, candidate management, AI-assisted scoring, async self-interviews, fraud / duplicate detection, scorecard sharing, and team collaboration features.

2. Accounts and tenants

  • You must be at least 18 years old and able to enter a binding contract.
  • One tenant workspace is provisioned per customer. The first user becomes the workspace Admin.
  • The Admin is responsible for inviting other team members and assigning their roles. Each user must keep their credentials confidential.
  • You are responsible for all activity that happens under your workspace, including the actions of users you invite.

3. Free trial

A 10-day free trial is available. The trial is limited (2 jobs, 25 candidates, 1 user) and ends automatically. No card is required to start a trial. If you do not subscribe by the end of the trial, the workspace is locked until you do.

4. Subscriptions and billing

  • Subscriptions are charged via Stripe. Plan details and prices are listed on our pricing page.
  • Charges are recurring (monthly or yearly, depending on the plan you choose) and renew automatically until cancelled.
  • Plan changes are prorated immediately. Downgrades may issue a credit on your next invoice.
  • Cancellations take effect at the end of the current billing period; access continues until then.
  • Refunds: we do not offer prorated refunds for partial periods, except where required by law.
  • Failed payments are retried by Stripe; if the payment ultimately fails, your workspace may be deactivated.

5. Acceptable use

You agree not to:

  • Upload content you do not have the right to upload (including resumes, names, or photos of candidates without a lawful basis).
  • Use the service to spam, harass, or impersonate anyone.
  • Attempt to bypass our security, our usage limits, or the per-tenant isolation that separates your workspace from another customer’s.
  • Reverse-engineer, scrape, or resell any part of the service.
  • Use AI outputs from the platform as the sole basis for an employment decision; AI scores are decision-support tooling, not a replacement for human judgment.
  • Use the platform in jurisdictions where its use would violate local employment, anti-discrimination, or AI-in-hiring law (e.g., NYC Local Law 144 disclosure requirements where applicable).

6. Your data

  • You retain ownership of all data you upload (jobs, candidates, applications, settings).
  • You grant us a limited license to process that data to operate the service for you.
  • We do not use your data to train AI models.
  • How we handle personal data is described in our Privacy Policy.
  • You are responsible for ensuring you have a lawful basis (consent, contract, legitimate interest, etc.) for any candidate data you upload.

7. AI outputs

Talent Tick produces AI-generated content: candidate scores, summaries, interview questions, and job description analyses. These are decision-support outputs, not decisions. You retain full responsibility for hiring decisions made by your team. The AI scoring rubric is deterministic and auditable; the AI-written portions (summaries, questions, JD rewrites) may occasionally produce inaccurate or misleading content. Review outputs before acting on them.

8. Service availability

We aim for high availability but do not guarantee uninterrupted service. Planned maintenance will be announced where possible. Scheduled downtime, third-party AI provider outages, and DDoS or force majeure events are not service breaches.

9. Suspension and termination

  • You may cancel your subscription anytime from the Stripe customer portal or by contacting us.
  • We may suspend or terminate your account if you breach these terms, fail to pay, or use the service in a way that endangers the platform or other customers.
  • On termination, you can request a data export within 30 days. After 30 days, your workspace data may be permanently deleted.

10. Warranties and liability

The service is provided “as is”. To the maximum extent permitted by law, we disclaim all warranties not expressly given in these terms. Our total liability for any claim arising out of these terms is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits, lost candidates, or lost hires.

11. Indemnity

You agree to indemnify us against third-party claims arising from your misuse of the service or from candidate data you upload without a lawful basis.

12. Changes to these terms

We may update these terms. Material changes will be announced via email to workspace admins at least 30 days before they take effect. Continued use after the effective date is acceptance of the new terms.

13. Governing law

These terms are governed by the laws of the jurisdiction where Talent Tickis registered. Disputes will be resolved in that jurisdiction’s courts unless otherwise required by local consumer-protection law.
